When you are buying a ticket, and coming on a tour, you agree with these terms and conditions. Please read carefully! We want you to know what to expect and how we operate.
- All of the tours are a historical and paranormal story telling presentation. The intention of the tour is not to scare you but entertain and inform you of a unique look at Denver. However, sometimes the locations we go into provide an unexpected chill or sensation. Numerous tours have experienced various forms of paranormal activity on the tour, but it is certainly not guaranteed.
- Sorry, no pets allowed unless it is a service animal with papers.
- You agree that you are always solely responsible for your own safety. You further undertake that in the light of this understanding, in case of any mishap, Dark Side of Denver Ghost Tours, and the owners of any property that you may transit during our tours, will not be held liable for any personal injury or property damage arising from your participation in any activity related to us.
- If you bring children or teenagers on the tour, the above applies to them too – with the provision that they must be always supervised by a responsible adult tour participant. This designated adult assumes total responsibility for seeing to it they participate in an orderly, civil and polite manner, keeping them safe, and for their actions. The tour does consist of adult themes and subject matter so expect some serious questions from your children during and after the tour. The tour is not vulgar or graphic but does discuss topics of various deaths, suicide, and other nefarious dealings.
- Anyone who chooses to be disruptive, unsafe or generally unpleasant will be asked to leave – and their ticket price is forfeited – that is, there will be no refunds given to anyone choosing to behave in an unpleasant or irresponsible manner on a tour.
- We do not refund ticket purchases simply based on an opinion that we were not scary enough or enjoyable enough for a particular person’s taste. This tour is a story telling experience. Just like with any form of entertainment, everyone has different things they like and don’t like. One person’s favorite movie might be the worst thing seen by another. Entertainment is subjective. We simply endeavor to deliver the best tour that we can, and you are completely responsible for your own emotional state and reactions to that. With that said, we are always open to constructive feedback.
- This tour does go out in the cold and in light rain. We spend over half the time inside the various locations of the tour so it’s usually not a problem. Extreme weather is a different story.
- If it is raining heavily, snowing, hailing, or severe lightning in the area, not only will it be unpleasant – it becomes potentially dangerous in some of the places we go on our tours. We make the determination day of tour whether the tour will be cancelled due to weather. If it is cancelled, you will receive a phone call at least 2 hours prior to tour start time informing you of the bad news. Unless notified otherwise – we run the tour. As a result, you will need to turn up on time, with sensible walking shoes, warm clothes as needed, and an umbrella if wet weather is predicted. In the event of bad weather and cancellation you will be offered to re-book another tour, issue a gift card, or a full refund. We will not penalize you because of mother nature.
- We run our tours based on demand, as established by advance bookings. We currently put our schedule out on a month-to-month basis. If you don’t see a future date available, please check back with us. Bookings must be made online at www.darksideofdenver.com or over the phone at (720)594-4678. Guides do not carry any money and cannot make bookings at the meeting location. Cash tips at the end of the tour for the guide are accepted and greatly appreciated.
- We will then confirm that you have a place on a given tour based on prior bookings. You will receive a conformation email after booking that will give you your meeting location for the tour. DARK SIDE OF DENVER GHOST TOURS RESERVES THE RIGHT TO DECIDE WHOM IS ENTITLED TO COME ON A GIVEN TOUR AND WHEN.
- If you are perceived in any way to be intoxicated by alcohol or drugs of any kind, we reserve the right to cancel your ticket and ask you to leave without the refund of the ticket. By putting yourself and others at risk due to your impaired judgement, you forfeit both the cost of the ticket and your right to participate in a tour.
- You agree to promptly follow the requests of Dark Side of Denver Ghost Tours staff during the running of the tour – this will be in the interests of your entertainment and safety.
- Cancellation of tickets within 24hrs of an individual booking will be refunded. Day of tour cancellation for individual bookings will not be refunded. Cancellation of private tours will be refunded if before 5 business days before scheduled tour. Week of bookings will not be refunded. If a genuine last-minute emergency occurs, please notify us if possible, by telephone AT LEAST 3 HOURS before the tour. We will consider allowing you to attend a later tour at our discretion and depending on availability. If you are fair and considerate of us, we will endeavor to do the same in return. No shows will not be refunded.
Waiver and Release
By taking part in a tour or event offered by Dark Side of Denver Ghost Tours, LLC, you or any members of your party you make a booking for agree to the terms of your (or your child’s or party’s) experience with Dark Side of Denver Ghost Tours, LLC and WAIVE YOUR RIGHT TO SUE US AND TO EXERCISE OTHER LEGAL RIGHTS.
READ ALL TERMS OF THIS AGREEMENT CAREFULLY
I, the Participant and/or the purchaser, agree to this release of all claims, waiver of liability and assumption of risk (“Waiver and Release”). I waive any and all claims I may have now and in the future, and release from all liability and agree not to sue Dark Side of Denver Ghost Tours, LLC [dba Dark Side of Denver and hereafter referred to as “the Company”], its owners, officers, agents, affiliates, hosting locations, representatives, employees or tour guides [hereafter referred to as “Releasees”] for any personal injury, death, property damage, or loss sustained by me as a result of my participation in any walking tours or events offered by the Company due to any cause whatsoever, including without limitation, negligence on the part of the Company, its Releasees, tour partners, or other participants, or death or injury as a result of war, civil unrest or epidemic. I further agree that if I violate this agreement and attempt to bring suit against any part of parties named herein, that I will be held responsible for attorney’s fees and any costs incurred by that person in defending such action.
I am aware that the tour or event, in addition to the usual dangers and risks inherent, has certain additional dangers and risks, some of which include: physical exertion for which I may not be prepared and weather extremes subject to sudden and unexpected change. I accept all the inherent risks of the proposed walking tour and the possibility of personal injury, illness (such as from COVID-19 and other communicable diesases), death, mental stress, or property damage or loss resulting there from. I agree that if I suffer injury or illness the Company or its Releasees can, at my cost, arrange any medical treatment and emergency evacuation service as it or they deem necessary for my health and safety.
Participant grants to Company and Company’s assigns the irrevocable, sub-licensable right and authority to use Participant’s name, likeness, photograph and/or picture for any and all commercial or non-commercial purposes now known or later developed in perpetuity throughout the universe without further obligation or compensation to Participant.
Further, I agree at all times during the tour or event, to abide by and comply with any additional instructions given by my tour guide or any other Staff and I accept that non-compliance may result in injury, death or permanent disability. I understand that non-compliance may result in my removal from the tour.
In entering this Waiver and Release, I am not relying on any oral, written nor visual representations or statements by the Company or its Releasees or any other inducement or coercion to go on the walking tour or event. I confirm that, by my own free will, I have read and understood the Terms and Conditions of this walking tour or event and Wavier and Release prior to purchasing a tour ticket or participating in a walking tour or event and agree that this Waiver and Release will be binding upon my heirs, next of kin, executors, administrators and successors.
As a participant on the tour or event, I accept full responsibility for my behavior, wellbeing, and health throughout the tour or event, which may involve a variety of activities, unfamiliar locations, and modes of travel, including but not limited to: climbing stairs. I further realize that the tour may involve walking through unfamiliar, and/or narrow, steep, or uneven corridors, roads, stairways and driveways.
This Waiver and Release of Claims constitutes the entire agreement and understanding between Participant and the Released Parties, and cancels, terminates and supersedes any prior agreement or understanding relating to the subject matter hereof. There are no representations, promises, agreements, warranties, covenants, or undertakings other than those contained in this Waiver and Release of Claims.
None of the provisions of this Waiver and Release of Claims can be waived or modified except expressly in writing signed by Participant and the party against whom the waiver or modification is sought to be enforced. Failure of any of the Releasees to enforce any of their rights hereunder at any time shall not act as a waiver to enforce their rights under this Waiver and Release for same or similar acts at any subsequent time.
By participating in a walking tour or event and/or purchasing the ticket(s), I affirm that I have fully understood and agree to these Terms and Conditions, Waiver and Release of Liability.
